TERMS AND CONDITIONS

These Terms & Conditions (the “Terms”) apply to your use of www.losmawis.com (the “Site”), run by WILIAM TORRES FILM S.A.S., the company behind Los MAWIS. By browsing the Site or sending us an inquiry, you accept these Terms. If you don’t agree with them, please don’t use the Site.

1. Who we are

Los MAWIS is the wedding photo and film studio of WILIAM TORRES FILM S.A.S., a company incorporated in Colombia (“Los MAWIS”, “we” or “us”).

2. What the Site is for

The Site shows our work and our services, including wedding and destination wedding photography and film, commercial projects and Mawicademy mentorship calls, and lets you contact us through the inquiry form. Nothing is sold on the Site: no bookings, purchases or payments are made through it.

3. Inquiries, proposals and bookings

  • Sending the contact form is a request for information. It doesn’t reserve a date, create a contract or oblige either of us to hire or provide a service.

  • We read every inquiry and reply with the next step, usually by email. If we’re available and the project is a fit, we send you a proposal (our MAWI Guide) with the scope, price and conditions.

  • Your date is reserved only when we have both signed the service contract and the deposit it sets out has been paid.

  • Each project is governed by its own service contract, which covers scope, price, payments, travel, delivery times, rescheduling, cancellation and the use of images. If the contract and these Terms differ, the contract prevails.

  • The investment range you choose in the form helps us suggest the right scope. It isn’t a quote and doesn’t bind you or us.

  • Please make sure the information you send us is accurate. We use it to prepare your proposal.

4. Information on the Site

  • We work to keep the information on the Site accurate and up to date. Service descriptions are general: the final scope and price of each project are confirmed in its proposal and contract, based on the date, place, coverage and deliverables.

  • Any prices we publish are in Colombian pesos (COP), include all applicable taxes and apply under the conditions shown with them. The specific conditions we advertise bind us on the terms advertised.

  • The stories in our gallery show our style and way of working. Every wedding is different, and so is every result. What we deliver in each project is what its contract sets out.

  • For destination weddings, travel and logistics are agreed in each proposal.

5. Commercial projects and Mawicademy

  • Commercial and brand projects have their own proposal and contract, which also set out how and where the material may be used (the license).

  • Mawicademy mentorship calls are educational sessions based on our experience. They don’t guarantee any specific professional or commercial result. The price, date and conditions of each call are confirmed when you book it.

6. Intellectual property

  • Everything on the Site, including photos, films, videos, texts, graphics, the Los MAWIS name and logo, the design and the code, belongs to WILIAM TORRES FILM S.A.S. or is used with its owners’ permission. It is protected by Colombian copyright and industrial property law, including Ley 23 de 1982 and Andean Community Decisions 351 of 1993 and 486 of 2000, and by international treaties.

  • You may view the content for your own personal, non-commercial use. Without our prior written permission, you may not copy, download, reproduce, distribute, publicly communicate, adapt or use it commercially, or remove credits or watermarks.

  • You may not use the Site’s content to train, test or feed artificial intelligence or machine-learning systems, or to create derivative works with them. Automated extraction, such as scraping, crawling or data mining, is not allowed.

  • You’re welcome to share links to the Site and to our official profiles.

  • Rights over the material we deliver to our clients are set out in each client’s contract.

7. People who appear in our work

The Site shows real couples, their families and their guests. We publish images in which a person can be identified only with their authorization, and we take particular care with images of children and adolescents.

If you appear in our content and want it removed, or you’re the parent or legal representative of a minor who appears in it, write to info@losmawis.com. We’ll review your request and answer within the deadlines in our Privacy Policy. When removal applies, we’ll take the content down from the Site and from our own social media profiles.

8. Third-party platforms and links

The Site includes videos hosted on Vimeo and YouTube, and links to other platforms such as Instagram and Pic-Time, where some of our galleries are hosted. Those services are run by third parties under their own terms and privacy policies. We don’t control them and aren’t responsible for their content, their availability or the data they collect on their own sites.

9. Acceptable use

When using the Site, you agree not to:

  • use it for illegal purposes or in breach of these Terms;

  • send false information or impersonate someone else;

  • try to access restricted areas, interfere with how the Site works or introduce malicious code;

  • extract content or data with automated tools.

10. Availability and liability

  • We may update, change or suspend the Site, or any part of it, at any time. We work to keep it available and secure, but we can’t guarantee it will always be free of interruptions or errors.

  • To the extent Colombian law allows, we aren’t liable for damage caused by interruptions or failures of the Site, of the internet or of third-party services beyond our control, or by any use of the Site that breaches these Terms.

  • Nothing in these Terms limits your rights as a consumer under the Colombian Consumer Statute (Ley 1480 de 2011), or any liability that the law doesn’t allow to be limited. Our liability for the services we provide is governed by each service contract and by law.

11. Personal data

We handle the personal data you send us through the Site as described in our Privacy Policy, in accordance with Ley 1581 de 2012 and its regulations.

12. Changes to these Terms

We may update these Terms. The current version will always be on this page, with its effective date. Changes apply from the moment they’re published and don’t affect contracts already signed.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Colombia. If a disagreement comes up, please write to us first: we’ll try to resolve it directly and in good faith. If we can’t, it will be decided by the competent Colombian judges or authorities, as the law provides, including the Superintendencia de Industria y Comercio (SIC) for consumer matters.
